    We exclusively handle in family law matters, including divorce, child support, child custody, alimony, and equitable distribution/property settlement.

    Bring all relevant documents (e.g., financial records, custody agreements, previous court orders, SAPS) correspondence so the attorney can thoroughly evaluate your situation.

  • 4. How do you charge for legal services?

    We typically discuss our fee structure during your initial consultation, including fee advances, flat fees, hourly rates, and any potential additional costs.

  • 5. How long does it take to resolve a divorce case?

    The duration varies depending on whether the matters are contested, the complexity of issues like property division or custody, and court schedules. Some cases settle quickly, while others take longer.

  • 6. What factors determine child support amounts?

    Child support calculations are based on North Carolina guidelines, except for extremely high earners, and consider factors like each parent’s income, custody arrangement, child care costs, health insurance, and extraordinary expenses. When the parties incomes put them of the Guidelines, a reasonable needs calculation is done.

  • 7. Can child support orders be modified?

    Yes — if there is a substantial change in circumstances (e.g., income changes, custody adjustments),  where the obligation changes 15* or more a support order can often be modified through the court.

    Custody decisions focus on the child’s best interests and may involve negotiation, mediation, or court hearings, depending on whether the parents agree on what the custodial agreement should be.

    Not always — many family law cases are resolved through negotiations or mediation, but court appearances are sometimes necessary if agreements cannot be reached.

    We evaluate financial situations and advocate for appropriate spousal support based on income, marriage length, and each spouse’s reasonable needs.

  • 11. What is equitable distribution?

    In a divorce, equitable distribution means dividing marital property and martial debts according to state law, though not necessarily equally. North Carolina is an equitable distribution state.

    Allan Brandon Tise has practiced law since 1986 and has handled thousands of trials and court hearings, giving him extensive experience in family law. He is a past President of the New Hanover County Bar and the Fifth Judicial District Bar.
